Once a trademark is federally registered, the owner of the registration must periodically file additional documentation with the United States Patent and Trademark Office to maintain the registration.
Among this documentation is a Declaration of Use, which the owner of the registration must file between the fifth and sixth anniversary of the registration. The owner must attest to use of the mark in commerce and also provide a specimen of use.
A Declaration of Use must also be filed at the time the trademark registration is renewed, which takes place between the ninth and tenth year of registration and every ten years thereafter.
